Copyright and public disclosure

Copyright

IHLIA’s archive contains copyrighted materials. The creator of a photograph, film or sound recording or text writing has the right to determine when and how the work created is used or becomes public.

Copyright remains in force until seventy years after the creator’s death. After the creator’s death, the heirs or the institution to which the rights have been transferred are the rights holders.

If you want to use the material, you must seek permission from the copyright holder. This applies to private use in addition to commercial reuse of the material.

Public disclosure

Disclosure is defined as:

  • Use in printed or digital publications (e.g. books, magazines, brochures, reports, annual reports, advertisements, etc.), whether or not on the internet.
  • Screening in a public space.
  • Broadcasting on radio and/or television.

Before you want to make material public, you need permission from any rights holders. This may be tied to a payment of a usage fee.

IHLIA may be the rights holder, but it usually involves third parties. In that case, IHLIA can inform you so that you can request written permission from the third party. Without permission, IHLIA cannot provide material.

If the copyright holder is unknown or untraceable, IHLIA cannot give permission for publication.

Personality law

A personal bond exists between the creator and his work. The protection of this is enshrined in the so-called personality law, which aims to protect the integrity of a work. If you have obtained written permission for publication, the material is delivered.

Two conditions arise from the personality law as to how you may use it:

  • The material may not be edited, i.e. it may only be used in its original form.
  • Attribution of the creator’s name is mandatory.

If you use material in a publication without the necessary permission from the copyright holder, they may take legal action. Failure to comply with personality law also has legal consequences.
