samenvatting: The main focus of this research is directed towards possible sources of arguments that might be rooted in different national contexts but can also be used at the international level, acknowledging that LGBT rights are not special privileges but basic human rights. The author collected arguments in order to present them as potential elements of future strategies to further human rights development, especially concerning issues of human dignity and free choice of lifestyles.

"We need a law for liberation" : gender, sexuality, and human rights in a changing Turkey.

samenvatting: Many lesbian, gay, bisexual, and transgender (LGBT) people in Turkey lead lives of fear, paralyzed by stigma. When singled out for harassment, violence, or other abuse, still an everyday occurrence for many, they also fear going to the authorities for assistance, and often for good reason: they have long experienced harassment and sadistic treatment by police and dismissive attitudes among judges and prosecutors. Despite reforms, new cases of such mistreatment continue to emerge, as this report demonstrates. This report is based on research conducted in a five-week field visit to Turkey in October and November 2003 and a four-week field visit to Turkey in October and November 2007, as well as prior and subsequent research.

Unsafe haven : the security challenges facing lesbian, gay, bisexual & transgender asylum seekers & refugees in Turkey

Istanbul [etc.]: Helsinki Citizens' Assembly [etc.], 2009 - 35 bl., [1] p. pl.
uitgave: Istanbul [etc.] : Helsinki Citizens' Assembly [etc.], 2009 - 35 bl., [1] p. pl.
onderwerpen:
thema:
  1. rechtspositie
  2. homoseksualiteit
samenvatting: This report is based on in-depth interviews with 46 LGBT asylum seekers and refugees living in Turkey, most of whom are Iranian. Their testimonials shed light on serious gaps in their protection. Most reported consistent, often violent harassment from local community members. They also described a lack of sufficient police protection in response to their complaints of violence, including admonitions that they stay home or dress "like a man" to avoid being targeted. Others reported being evicted from home on the basis of their sexual orientation or gender identity. The few able to secure work described being violently forced off the job when their LGBT status was exposed. Yet others reported identity-based barriers accessing social services and education. These LGBT asylum seekers and refugees are subjected to a particularly caustic mix of marginalization in key areas of life, preventing them from obtaining assistance or employment, and depriving them of even the most basic security during their lengthy stay in Turkey. Most live out their time in Turkey in destitution and desperation.

The right that dares to speak its name : Naz Foundation vs. Union of India and others : decriminalising sexual orientation and gender identity in India  / [text comp. and ed. by: Arvind Narrain, Marcus Eldridge].

samenvatting: The judgment of the Delhi High Court in Naz Foundation vs. Union of India, delivered on 2nd July, 2009, triggered a euphoric response from the Lesbian, Gay, Bisexual and Transgender (LGBT) community as well as from the wider activist community. The judgment was at the same time both a remarkable assertion that LGBT persons are indeed a part of the Indian nation as well as a statement that the judiciary remains an institution committed to the protection of those who might be despised by a majoritarian logic. What the Naz judgment also triggered was a wider conversation on LGBT rights in living rooms, offices and tea shops across the country. LGBT persons were out of the closet and literally onto the front pages of all Indian papers and news channels. It's very rare for a judgment to have such an instantaneous social impact as to actually begin a national conversation. Huge as the impact of this pronouncement was, not many can directly access this judgment due to the sometimes inaccessible nature of legal language. This compilation aims to aid a wider comprehension of the nature, the logic and reasoning followed by the Delhi High Court as well as to understand the implications of the Naz judgment. It aims to contextualise, elucidate and explicate on the Naz judgment.

Mujigae Korea  / Douglas Sanders.

  1. rechtspositie
  2. homoseksualiteit
samenvatting: The existence of homosexuals in South Korea was routinely denied in the past. In the 1990s a number of changes began, notably the expansion of the gay bar scene, a set of activist organizations and public "pride" events. The firing of popular television actor Hong Suk Chun in 2000 was a major public event, giving new visibility to homosexuals. The sensational transsexual star Harisu has also changed public perceptions. The new international support for "human rights" led South Korea to establish a National Human Rights Commission in 2001. The Commission had a mandate to deal with discrimination on the basis of "sexual orientation" and acted positively on that mandate, including funding gay and lesbian organizations to carry out particular programs.
