samenvatting: Summary of 17 country reports from the UPR (Universal Periodic Review which started in April 2008 and consists of the review of the human rights practices of all States in the world, once every four years) on SOGI (Sexual Orientation and Gender Identity Project) issues. For 3 countries there were no references during the Working Group session and 4 countries rejected recommendations. For the 9 other countries there are an annex. In 6 of these the COC was a participant.

samenvatting: Although the PDHJ has no specific focus on SOGI or HIV, the scope of the PDHJ's mandate ensures that should complaints be lodged, or should violations occur on the basis of SOGI, such cases will fall within the PDHJ's mandate. Both the PDHJ's investigation and monitoring powers are relevant. dealing with LGBT-related rights will require scaled up PDHJ monitoring and increased PDHJ capacity at a local level, as well as bilateral efforts to strengthen PDHJ-NGO relationships.

samenvatting: In much of Asia, stigma and discrimination on the basis of diverse sexual orientation and/or gender identity (SOGI) strips people of their rights and excludes them from mainstream health programs, public and private services, and economic opportunity. Over the year to March 2013, the International Development Law Organization (IDLO), the United Nations Development Programme (UNDP), SAARCLAW (the legal apex body of the South Asian Association for Regional Cooperation) and the Asia Pacific Forum worked with national human rights institutions (NHRIs) in Bangladesh, India, Indonesia, Nepal, the Philippines, Sri Lanka and Timor Leste to document their capacity to promote SOGI rights and respond to violations.

samenvatting: In August 2016, during the ASEAN Civil Society Conference / ASEAN People's Forum in Dili, ASEAN SOGIE Caucus (ASC) engaged for the first time with people from Timor-Leste's lesbian, gay, bisexual, transgender, intersex, and queer (LGBTIQ) community. In collaboration with ISEAN HIVOS Program (IHP) and the Coalition of Diversity and Action (CODIVA), ASC organized "Rainbow Solidarity: Strengthening Ties Among LGBTIQ Activists in ASEAN", where activists talked about what it was like to be LGBTIQ in their countries. During the activity, ASC committed to support LGBTIQ activism in Timor-Leste, affirming the country's emerging role for LGBTIQ advocacy in Southeast Asia. As part of this commitment, this discussion paper was produce to highlight the key issues shared with us by activists, and identify ways forward for advocacy in Timor-Leste.

samenvatting: This report analyses the human rights situation of Southeast Asia's LGBTIQ Communities and their defenders in Southeast Asia in the decade since the UPR and the Yogyakarta Principles were introduced. It documents both the legal framework and the factual reality in each of the 11 Southeast Asian States: Brunei, Cambodia, Indonesia, Laos, Malaysia, Myanmar, The Philippines, Singapore, Thailand, Timor-Leste en Vietnam. The report also details numerous situations where States in Southeast Asia have actively limited the rights of the LGBTIQ community and LGBTIQ HRDs. Harsh laws and criminal sentences have been imposed for consensual same-sex sexual relations. Discrimination and serious abuses continue to occur. Institutions and officials have adopted positions unsupportive of LGBTIQ rights. Multiple States have also restricted the fundamental freedoms of LGBTIQ HRDs, including freedoms of assembly, expression, and association. On a regional level, therefore, LGBTIQ communities and their HRDs remain at risk overall - and with them, the future of LGBTIQ rights in Southeast Asia.

samenvatting: OutRight Action International participated in the APF (Asia Pacific Forum)'s initiative by visiblizing to NHRI (National Human Rights Institutions)'s the violations faced by LGBT people in the region. OutRight was also part of the team of LGBT human rights experts that assisted the ACJ (Advisory Commission of Jurists) in its deliberations on the interpretation and application of international human rights standards with regard to SOGI. This scorecard is a review of how effectively NHRIs have implemented ACJ recommendations between 2011 and 2016 and what contributions they made towards LGBT enjoyment of universal human rights.

samenvatting: Executive summary: Asia is marked by diverse cultural, political, economic, and legal systems. Lesbian, gay, bisexual, transgender, and queer (LGBTQ) people in the region experience diverse forms of violence in the contexts of family and intimate partner relations. As with cisgender heterosexual women, much of the domestic violence committed against LGBTQ people masquerades as customs and traditions. In countries where there are laws addressing domestic violence, redress and services do not adequately encompass LGBTQ survivors. As a result, they are often unable to seek justice and access institutional support. This report examines the domestic violence national legislation of ten countries in Asia - China, India, Japan, Malaysia, Nepal, Philippines, Singapore, Sri Lanka, Timor-Leste and Thailand - in order to locate LGBTQ survivors in these laws. The report analyzes the provisions in each country's domestic violence law in order to determine their responsiveness to the contexts and needs of LGBTQ survivors of domestic violence. To achieve this, the report plots the relevant components of the laws vis-à-vis the potential tensions and opportunities therein for LGBTQ-inclusive interpretation and implementation. A significant number of studies have been conducted for the purpose of mapping the legal frameworks of domestic violence legislation in Asia, but none of these studies substantively reference the situation of LGBTQ people. This situation contributes to the further invisibilization of LGBTQ people in discourses on domestic violence and reform efforts to institute or strengthen legal mechanisms to address it. The legal information on existing Asian domestic violence legislative frameworks, as well as the commentary and recommendations included in this report, aim to contribute to the array of resources that can be used in advocating for legal remedies for LGBTQ survivors of domestic violence.

The report gives examples of how challenges faced by LGBTI people can be directly linked with the SDG (Sustainable Development Goal)'s and human rights frameworks, as well as how recommendations from the human rights systems regarding LGBTI rights can be integrated in country Voluntary National Reviews (VNRs) of SDG progress. The conclusion points to significant potential to increase the synergies between human rights and SDG reporting and related implementation to ensure that 2030 Agenda implementation is guided by a human rights-based approach and fulfils the rights of LGBTI people. The report contains concrete recommendations for governments, human rights bodies, National Human Rights Institutions as well as civil society organisations, including LGBTI rights holders organisations.
