samenvatting: Given their capacity to mask, mute, and bureaucratize the human voice, institutional settings remain particularly potent spaces for the interpersonal and systemic enactment of homophobia and transphobia. Tremendous obstacles exist in providing effective, high-quality services to lesbian, gay, bisexual, transgender, and queer (LGBTQ) adolescents in the child welfare and juvenile justice systems. This article reviews and critically analyzes the small body of literature pertaining to LGBTQ youth in the foster care system in the United States. It identifies systemic biases shared between the child welfare and juvenile justice systems and argues that they have jointly become warehouses for LGBTQ youth trapped within their midst. The article concludes with suggestions for policy reform and argues for the need to embrace an intersectional lens in child welfare and juvenile justice research, policy, and practice

samenvatting: Little is known about the behavioral risk factors for HIV and other sexually transmitted infections (STIs) among female youths who identify as lesbian, gay, bisexual, or questioning (LGBQ) and who are involved in the juvenile justice system. We examined the sexual and drug use risk profiles of heterosexual and LGBQ female adolescents in the justice system. Greater prevalence of alcohol and substance use was found among female LGBQ adolescents compared to their female heterosexual counterparts. Conversely, female LGBQ youths reported more consistent condom use for both vaginal and anal sex compared to heterosexual females. These data may be useful in tailoring interventions for justice-involved LGBQ youths. (Copies are available at http://www.tandfonline.com/doi/full/10.1080/10538720.2016.1158137)

samenvatting: The purpose of this paper is to report new national data on the over-representation of lesbian, gay, bisexual, questioning, gender nonconforming, and transgender youth in the juvenile justice system and to provide recommendations for key justice stakeholders on how to best serve these youths. This paper is based on surveys collected from 1400 youth in seven juvenile detention halls across the country.

samenvatting: Although there is a growing body of work on the experiences of girls in juvenile justice and women in prison, still little is known about the experiences of Latinas in the prison pipeline. Accordingly, even less is known about lesbian/queer Latinas in the prison pipeline. Gabriela's case study reveals her experiences in and out of the Juvenile Justice System as she seeks to build her life upon release as a young adult raised in multiple institutions. Using a Critical Race Theory and Latina/o Critical Race Theory (LatCrit) framework, this case study shows how Gabriela's intersectional identities have impacted her experience of going into and coming out of the prison pipeline. By focusing on her intersectional identity, I argue a for a new type of microaggression, which I refer to as gender non-conforming microaggressions, that explains the ways in which her gender performance and transgressions coupled with her sexuality and race create situations wherein she was insulted and criminalized.

samenvatting: Abstract: LGBTQ people are sent to prison for a wide range of convictions, with most tracing their first incarceration to their juvenile years. LGBTQ youth are disproportionately represented in the juvenile "injustice" system. Once inside, there is systemic discrimination against the incarcerated LGBTQ community and a lack of understanding concerning the need for care and treatment of certain members of the community. Within the incarcerated transgender community, evidence clearly shows high levels of abuse and non-treatment (medical, mental health, and rehabilitation programs). Considerable efforts must be made to establish policies and programs to help prevent LGBTQ children from entering the system and, in the event that they do, to ensure they have the education, access to rehabilitative programs, and trade skills necessary to survive outside of the criminal justice system later. To address issues experienced by incarcerated LGBTQ adults, a starting place is the provision of LGBTQ-inclusive programing, designed in consultation with the prisoners themselves. Many of the recommendations for the currently incarcerated populations cost little to nothing in additional funding, but they do require time and the willingness to update current programs and modify others to include the LGBTQ incarcerated community.
